The subject of this article is a complex analysis of control tools for the construction of wind power stations. In the opening part this type of buildings is presented as a unique phenomenon with important potential to change the Czech landscape. For this reason it is necessary to adapt some appropriate control tools for their construction. The article is based on analyses of two basic institutes regulating the construction of wind power stations in the Czech Republic: the EIA assessment process and the physical planning processes at the level of municipalities and Regions. Evidently the relation between these processes determines significantly the expected outcome. A certain confusion can be identified in the results of EIA assessments. Although the political process of the delimitation of plots available is one of the decisive factors for the construction of wind power stations, the unpredictable results of EIA sometimes interfere in this autonomous competence of territorial administration. Also based on an analysis of regulations effective in Germany, the article suggests two basic options for the solving of these issues.

Tématem článku je komplexní analýza nástrojů regulace výstavby větrných elektráren. Tento typ staveb je v úvodu představen jako jedinečný fenomén, s významným potenciálem proměnit českou krajinu. Z toho důvodu je třeba tomuto typu staveb odpovídajícím způsobem přizpůsobit regulační nástroje. Text vychází z analýzy dvou základních institutů upravujících výstavbu větrných elektráren v České republice, kterými jsou proces posouzení EIA a územně plánovací procesy na úrovni obcí i krajů. Ukazuje se, že vztah těchto procesů významně předurčuje, jaký by měl být jejich výstup. Především ve výsledcích jednotlivých posouzení EIA lze identifikovat určitý zmatek. Ačkoliv je pro výstavbu větrných elektráren určující částečně politický proces vymezení odpovídajících ploch v územně plánovací dokumentaci, poměrně nepředvídatelné výstupy procesů EIA do této autonomní kompetence územních samosprávných jednotek v některých případech zasahují. I na základě analýzy pravidel platných v sousedním Německu jsou navrženy dvě základní možnosti, jak předmětné otázky řešit.
