Udział prokuratora w procesie sądowoadministracyjnym jest nieodzowny i konieczny. Prokurator ma stać na straży praworządności i dbać oto, aby interes publiczny nie doznał uszczerbku w wyniku bezprawnej działalności administracji publicznej. W tym celu ustawodawca w taki sposób skonstruował legitymację prokuratora, aby jak najpełniej mógł on realizować powierzone mu zadania na gruncie postępowania przed sądami administracyjnymi.

Participation of the prosecutor in administrative court proceedings is essential and necessary. The prosecutor has to uphold the rule of law and ensure that the public interest has not suffered damages as a result of unlawful activities of public administration. For this purpose the legislature constructed the legitimacy of the prosecutor in such a way to enable to carry out its tasks on the basis of proceedings before administrative courts.
