A pardon is an institution of law that is between substantive and procedural criminal law and constitutional law. The essence of the power of pardon is the remission or mitigation, by the head of State, of public law sanctions of a criminal nature, imposed by a final judgment, or of the consequences of the application of such sanctions to an individually indicated person. The purpose of this article is to address some of the relevant extra-criminal-law consequences of an act of pardon – in constitutional law, labour law, civil (commercial) law and administrative law. The authors analyse whether a pardon may be retroactive. Particular attention is paid to the issue of the termination of the mandate of a deputy or senator as a result of a final sentence of imprisonment. Such termination of the mandate of a deputy or senator occurs (according to the dominant view) by virtue of law, so that a pardon granted after the termination may not reinstate that mandate.

Celem artykułu jest zbadanie, w stosunku do jakich sankcji można zastosować prawo łaski (art. 139 Konstytucji RP). Bazując na systemowej wykładni Konstytucji RP, autor stawia tezę, że prawo łaski jest „rewersem” pojęcia odpowiedzialności represyjnej wyprowadzanego z art. 42 Konstytucji RP. W konsekwencji w stosunku do wszystkich sankcji o charakterze represyjnym w rozumieniu art. 42 Konstytucji RP można zastosować prawo łaski. Pozwala to na stwierdzenie, że prawo łaski można stosować do m.in. kar dyscyplinarnych, kar lustracyjnych administracyjnych kar pieniężnych, dodatkowych zobowiązań podatkowych i kar orzekanych wobec podmiotów zbiorowych. Zasygnalizowane zostają wyzwania dla nauki prawa, w tym możliwość kolizji stosowania prawa łaski z innymi przepisami konstytucyjnymi.

The aim of this article is to discover in relation to which sanction it is possible to exercise the right of pardon (art. 139 of the Constitution). Basing on the systemic interpretation of the Constitution, the author argues that the power of pardon is the ‘reverse’ of the notion of repressive liability inferred from art. 42 of the Constitution. Consequently, in relation to all repressive sanctions within the meaning of art. 42 of the Constitution it is allowed to grant a pardon. Therefore it is possible to claim that a power of pardon can be applied to, inter alia, disciplinary penalties, lustration penalties, administrative monetary penalties, tax surcharges and penalties imposed on collective entities. Challenges for the doctrine of law – including possible collisions between exercising power of pardon and other constitutional provisions – are indicated.
