In the present paper attention is focused on several matters. First of all, the standpoint of some churches and confessional associations concerning the model of upbringing has been presented. All standpoints presented concentrate on assurance for parents and committees of the right to decide on the kind of upbringing which their child should receive. A similar standpoint has been presented by an employer in international law as well as in Polish legal system. Moreover, it has been noticed that there is some convergence in ecclesiastic and secular approaches in the matter concerning the ability of establishing private schools and sending children there.

Service regulations which define employment of uniform service officers in regards to parental rights, predicts provisions which refer to applying the provisions of the Labour Code. It means that, the services regulations are not complete, and therefore application of provisions from other law systems is allowed. Another example of relations between a uniform service employment and the labour law, is introducing rules to service regulations which are similar (or identical) to a labour law. As previously mentioned, the amount of benefit payment during the leave related to childcare, has been regulated in the same way to they employees who take this kind of leave. Making officer’s status similar to employe’s status cause diverse consequences for officers. Some of them are more favorable to officers, for example parental rights. In this way, officers can benefit from these rights regardless of gender. Almost in the same way as employees, officers also have a right to additional maternity leave and childcare leave. Other changes, in relation to making officer’s status similar to employe’s status, cause however loss of service officers’ privileges, for example decreased pay during sick leave.

Charter of the Rights of the Family is a particular document issued by the Holy See in order to show the fundamental family’s rights, which should be respected and protected due to family is a natural community. The proper functioning of each family has significant meaning for both Church and state legislation. In particular, it should be noted that parents have a material impact on educating their children. The Holy See in the Charter of the Rights of the Family enumerated rights which should be guaranteed. The article includes analysis the Charter of the Rights of the Family formulated by the Holy See, particularly the parents’ right to educate their children in conformity with their moral and religious convictions. At the beginning the Author emphasised specific nature of the Charter of the Rights of the Family which expresses the thought of the Church in this field. It could be considered as sui generis document of the Holy See, partly doctrinal, partially normative. Natural law is primary source of the Charter of the Rights of the Family what was confirmed in the introduction to this document. The Holy See notices, that parents have the primary right to educate their children, because they have given birth their children. The Character of the Right of the Family does not define the concept of “family”, however family can realize their rights. There is characterized parents’ right to educate their children and the necessity of its protection. It should be emphasised that Holy See called on the states and international organisations to protect the family.
