Niniejszy artykuł analizuje problematykę symboli religijnych jako wyrazu wolności religijnej w polskich szkołach. Zasadniczą podstawą dla wyciągniętych wniosków był wyrok Europejskiego Trybunału Praw Człowieka z 3 listopada 2009 r. Trybunał stwierdził, że obecność krzyża w szkołach włoskich stanowi pogwałcenie praw rodziców do wychowania dzieci zgodnie z ich przekonaniami. Autor artykułu odnosi się do poszczególnych kwestii w wyroku ETPC, analizując je w odniesieniu do obowiązującej w Polsce legislacji.

The present article investigates the issue of religious symbols as an expression of the religious liberty at Polish schools. The essential condition for the conclusions drawn was the judgement of the European Court of Human Rights from November 3rd, 2009. The court stated that the presence of a crucifix at Italian schools is the violation of the parental right to educate their children according to their beliefs. The author of the article refers to the particular matters of the judgement of ECHR examining them with reference to current Polish legal regulations.

Zgodnie z Kodeksem Prawa Kanonicznego z 1983 r. dzieckiem nazywa się małoletniego przed ukończeniem siódmego roku życia i uważane jest za nieposiadające używania rozumu. Uprawnienia przysługujące dziecku mają podstawę zarówno w naturalnej osobowości prawnej, jak i w kościelnej osobowości prawnej. Ustawodawca w Kodeksie Prawa Kanonicznego z 1983 r. reguluje m.in. następujące prawa dziecka: prawo do życia, prawo do sakramentów, prawo do wychowania.

According to the 1983 Code of Canon Law the child is a minor before the completion of the seventh year, who is considered not to be responsible for itself. The rights of the child stem both from natural legal personality and church legal personality. The 1983 Code legislator regulates rights of the child such as: the right to life, right to the sacraments and right to upbringing.

One of the most important question at present times is a question concerning educational role of parents especially fundamental truths about their rights in bringing up their children. The article discusses truths related to a family as a basic educational environment. A motive for choosing The Book of Proverbs to some analysis about this is a fact that this source is a part of The Old Testament and it is the underlying cause of educational systems formulation. Main themes include: parents` rights to bring up children, parents` dignity as tutors and childrens` improper behaviour towards their parents.
