: The essence of pre-election silence is to create conditions in which voters could form their electoral preferences and cast their votes freely and without political canvassing. The main aim of this article is to answer the questions about the sense of pre-election silence in the era of new media (especially the Internet) and about the violations of pre-election silence on the Internet. The reason for addressing this issue is the appearance of both: a large number of media reports about online canvassing and doubts about the sense of continuing the functioning of pre-election silence.

Agitacja wyborcza jest zagadnieniem wzbudzającym kontrowersje przy okazji każdych kolejnych wyborów. Jest to zagadnienie wielowątkowe, którego kompleksowe przedstawienie nie jest możliwe w ramach krótkiego opracowania. Właśnie dlatego autor dokonał subiektywnego wyboru treści, skupiając się na omówieniu istoty agitacji, a także wskazując na ukształtowanie się swoistego prawa obywatelskiego do agitacji. Oczywiście agitacja wyborcza doznaje pewnych ograniczeń. Autor dokonał ich przedstawienia, wskazując na te z nich, które związane są z miejscem a także czasem prowadzenia agitacji wyborczej.

The pre-election agitation is a controversial problem occurring in every election. It  is not possible to  present this problem in  all-embracing way in  this little study because it is a very multithreaded issue. Concerning that, the author subjectively limited the content focusing on an essence of agitation and pointing the civil right to agitation of every citizen. Obviously the agitation may be restricted in some way. The author presented this sort of cases pointing these related with a place and a time of agitation.
