Wypowiedź może być jednocześnie zniewagą i zniesławieniem. Znieważenie następuje niezależnie od tego, czy znieważany jest zdolny do jego percepcji. Zniewaga jest przestępstwem powszechnym, ma charakter umyślny i może być dokonana w zamiarze bezpośrednim. Ustawodawca bardzo ogólnie określa przestępstwo z art. 216 kk. Zniewagą są zachowania wyrażające pogardę dla godności drugiego człowieka. Znieważenie może przybrać postać słowną (np. wulgaryzmy) w formie ustnej i pisemnej.

A statement can be seen both as an insult and defamation. According to the law, insult takes place regardless of whether the insulted person is capable of understanding it. An insult is a crime that can be perpetrated by any offender; it is committed intentionally and in a form of direct intention. The legislator in Poland defines the crime in art. 216 of the Criminal Code in a general way. The research emphasises that insults are those behaviours which express contempt for the dignity of another human being. Referencing to the law, it argues that insult can take both the verbal/oral (eg. vulgarity) and a written form.
