Punishment, its purpose and essence is a research issue around which many controversies have arisen. Previous studies indicate that almost everything has been said about the punishment. However, it is important to point out that the future of punishment and penalization, and issues that continue to raise topics for discussion, are important areas. Penalty plays an important role in the social sphere and highlights important issues such as substance, prevention and punishment.

Kara, jej cel i istota to zagadnienie badawcze, wokół którego narosło wiele kontrowersji. Dotychczasowe badania wskazują, że o karze powiedziano już prawie wszystko. Jednak należy zaznaczyć, że ważnym obszarem jest przyszłość kary i karania oraz zagadnienia, które nadal stają się tematem do dyskusji. Kara odgrywa ważną rolę w obszarach społecznych i należy podkreślać ważne zagadnienia, jakimi są istota, profilaktyka oraz celowość kary.

The subject matter of the present article concerns the concepts created by Polish legal scholars in the field of the theory of punishment, which were developed during the period of interwar Poland (1919–1939) and the Polish People's Republic (1945–1989). The paper presents these concepts as well as the conclusions of the Polish legal scholars’ deliberations on the essence of criminal punishment and its goals. Furthermore, it indicates which theoretical concepts were implemented in the regulations of the penal codes of 1932 and 1969. Finally, the text presents an assessment of the state of research on the theories of punishment in 20th-century Poland and it indicates further research perspectives.

Przedmiotem artykułu są koncepcje polskich przedstawicieli nauki prawa w zakresie teorii kary, które powstały w okresie Polski międzywojennej (1919–1939) oraz Polski Ludowej (1945–1989). Przedstawiono w nim koncepcje polskich uczonych oraz wnioski płynące z ich rozważań nad istotą kary kryminalnej i jej celami. Wskazano, które koncepcje teoretyczne znalazły swój wyraz w przepisach kodeksów karnych z 1932 i 1969 r. Na koniec oceniono stan badań nad teoriami kary w Polsce XX wieku i ukazano dalsze perspektywy badawcze.
