Artykuł stanowi próbę zasygnalizowania problematyki zasad, sposobów oraz podmiotów uprawnionych do orzekania o należnościach kuratorów procesowych. W opracowaniu przedstawiono opis rozstrzygania o wynagrodzeniu i innych kosztach kuratora, uwzględniając przy tym poglądy jurysprudencji oraz orzecznictwa. Poruszone zostało także zagadnienie dopuszczalności orzekania o wynagrodzeniu kuratora procesowego przez referendarza sądowego. Na koniec zaprezentowano wnioski de lege ferenda w zakresie tytułowej tematyki.

The article constitutes an endeavour of signalization of the issue connected with rules, methods and entities entitled to predicate the costs of procedural court officers. The description of the adjudication on court officers’ fees and their other costs with selected views of jurisprudence and judicature were introduced in the case study. The article comprises also the issue of the admissibility of predicating on court officers’ fees by the court referendary. Finally, de lege ferenda views on the subject matter were presented.

Glosa stanowi aprobującą ocenę uchwały Sądu Najwyższego w sprawie III CZP 118/16. Opracowanie porusza trzy zasadnicze zagadnienia: stosunek art. 203 § 2 zd. 2 k.p.c. do art. 98 § 1 k.p.c., zasady oceny oświadczenia o cofnięciu pozwu w kontekście kosztów postępowania oraz konsekwencje cofnięcia pozwu w związku z wyegzekwowaniem roszczenia w toku procesu w sferze jego kosztów.

The gloss is an affirmative appraisal of the Polish High Court resolution in case III CZP 118/16. The text considers three main issues: the relation between Article 203 § 2 second sentence of the Civil Procedure Code and Article 98 § 1 of the Civil Procedure Code, rules of the assessment of the claim’s withdrawal statement in the light of the civil proceedings’ costs, and the consequences of claim’s withdrawal in connection with consideration’s execution during litigation in reference to its costs.
