The article deals with the legal aspects of implementing a compliance management system in the public sector, using the example of the mining sector. Taking into account the achievements of administrative law and European Union law, the author points to a new legal issue, which is at the stage of implementation into the national system of law. In pursuing the research objective, the author analyses the legal aspects of implementing the Compliance management system by public entities. In particular, the author analyses the compliance management systems of two listed companies in the mining sector. As a result of the legal analysis, the author concluded that the legal basis for the implementation of Compliance management systems in the mining sector should have its legal basis in the Geological and Mining Law.

Artykuł poświęcony został prawnym aspektom wdrażania systemu zarządzania Compliance w sektorze publicznym na przykładzie sektora górniczego. Autor uwzględniając dorobek prawa administracyjnego i prawa Unii Europejskiej wskazuje na nowe zagadnienie prawne, znajdujące się na etapie wdrażania w krajowy system prawa. Realizując cel badawczy autor dokonuje analizy prawnych aspektów wdrażania systemu zarządzania Compliance przez podmioty publiczne. W szczególności autor dokonuje analizy systemów zarządzania Compliance w dwóch giełdowych spółkach z sektora górniczego. W wyniku przeprowadzonej analizy prawnej autor doszedł do wniosku, że prawne podstawy wdrażania systemów zarządzania Compliance w sektorze górniczym powinny mieć swoją podstawę prawną w prawie geologicznym i górniczym.

The fundamental issue raised in this elaboration comes down to a trial of defining the character and content of the specificities of the identify the draft law on transparency of public life, in the regulation on internal anti-corruption procedures. There were analysed the responsibilities relating to the preparation and implementation of appropriate procedures, including the obligation to prepare the required documents.
