Prawo do ochrony zdrowia w Konstytucji Republiki Włoskiej zajmuje wśród praw i wolności pozycję szczególną, a włoski Sąd Konstytucyjny wielokrotnie zajmował się tą problematyką w swojej praktyce orzeczniczej. W artykule poddano analizie wybrane orzecznictwo włoskiego Sądu Konstytucyjnego z zakresu ochrony zdrowia, w szczególności odnoszące się do problematyki przymusowego leczenia i związanej z nim zasady wyrażania zgody przez pacjenta na świadczenia zdrowotne, granic uporczywej terapii, podstawowych poziomów świadczeń zdrowotnych, jak również konstytucyjności prze-pisów dotyczących problematyki sztucznego zapłodnienia (in vitro)

The right to health care in the Constitution of the Italian Republic holds a special position among the rights and freedoms while the Italian Constitutional Court has many times dealt with this problem in its judicial practice. The article focuses on the analysis of the selec-ted case law of the Italian Constitutional Court in relation to health care, in particular the one relating to the issue of involuntary treatment and the principle of patient consent to he-alth care, the limits of forced medical treatment, basic levels of health services as well as the constitutionality of the regulations relating to the issue of artificial fertilization (in vitro)

Racje i emocje w dyskusji na temat ingerencji genetycznych w ludzką prokreację

W artykule przestawione zostały etyczne problemy zastosowania nowoczesnych technik ingerencji genetycznych w ludzką prokreację. W szczególności rozważone zostały krytycznie argumenty racjonalistyczne za ingerencjami genetycznymi, w tym argument dotyczący neutralności etycznej technologii, liberalny argument swobody prokreacyjnej oraz argument dotyczący genetycznego ulepszania populacji. Analizie została również poddana negatywna reakcja emocjonalna w stosunku do inżynierii genetycznej, a celem artykułu było wydobycie z niej aspektów poznawczych, dotyczących szerszego rozumienia znaczenia prokreacji ludzkiej i wartości relacji rodzicielskiej.

In this paper, there were presented ethical arguments concerning the application of modern techniques of genetic intervention in human procreation. In particular, the rationalistic arguments in favour of genetic interventions were critically presented, namely the argument on ethical neutrality of technology, liberal argument on procreative freedom and argument on genetic enhancement. There were also analysed the negative emotional reaction to genetic engineering. The main aim of the paper was to express the cognitive element from these emotions enabling a wider understanding of human procreation and the values of parent-child relations.
