Zagadnienie prawnych ograniczeń reklamy telewizyjnej produktu leczniczego jest w swej istocie związane z kwestią reklamy specyficznego, wrażliwego produktu przy pomocy specyficznego, silnie oddziaływującego medium. Wymienione wyżej aspekty podjętego tematu oraz konieczność ochrony życia i zdrowia uzasadniają określone ograniczenia prawne takiej reklamy, ustanowione przez ustawodawcę. W artykule składającym się z pięciu części Autorka podejmuje próbę naszkicowania wyznaczonego przez przepisy prawa modelu telewizyjnej reklamy produktu leczniczego – definiuje podstawowe pojęcia, prezentuje merytoryczne ograniczenia telewizyjnej reklamy produktu leczniczego oraz uzupełniające je formalne ograniczenia reklamy tego typu i formułuje wnioski.

The idea of legal restrictions on TV advertising of a medicinal product is – in its core – the question of advertising of a very particular and sensitive product through a particular and strong affectting medium. Above mentioned aspects of the problem along with the need to protect human life and health justify the legal restrictions set by the state legislator. The article ,structured into five parts, consists of the author’s analysis of the legal regulations concerning the main problem and her attempt to answer the underlying question. The researcher points to the legal model of TV advertising of a medicinal product – defines basic concepts, presents limitations (substantive and formal) on TV advertising and draws finally conclusions.

This article is based on analysis of the laws established by the Parliament of the Republic of Poland in 2011. and their justifications. The author seeks and presents what social or economic goals pursued by the legislator when making changes or creating new laws. Subject matter touched in the article focuses on many important aspects of our lives such as insurance system, health safety, public roads safety, family safety, or issues related to the environment. Thanks to laws presented in the article, we can see in which direction and what are for changes in our legislation.
