W artykule przedstawiono problematykę stosowania przepisów postępowania cywilnego w okresie epidemii COVID-19, ze szczególnym uwzględnieniem regulacji dotyczącej: (1) możliwości przeprowadzania rozpraw i posiedzeń jawnych w trybie zdalnym za pomocą urządzeń do porozumiewania się na odległość; (2) zarządzenia przeprowadzenia posiedzenia niejawnego zamiast rozprawy lub posiedzenia jawnego; (3) zamknięcia rozprawy i wydania wyroku na posiedzeniu niejawnym; (4) dodatkowych wymagań formalnych wobec pism w sprawach rozpatrywanych na posiedzeniu zdalnym; (5) doręczeń pism za pośrednictwem portalu informacyjnego. Celem artykułu jest omówienie głównych rozwiązań przyjętych przez ustawodawcę w zakresie postępowania cywilnego, mających na celu zapobieganie, przeciwdziałanie i zwalczanie COVID-19 z uwzględnieniem ich funkcjonalności. Omówiono również nowelizacje przepisów i ich wpływ na przebieg toczącego się już postępowania cywilnego.

The article presents the issues related to the application of the provisions of civil procedure during the COVID-19 epidemic, with particular emphasis on the regulation of the possibility of holding hearings and public hearings remotely by means of remote communication devices; ordering a closed session instead of a hearing or a public hearing; closing a hearing and issuing a judgment in closed session; additional formal requirements for letters on matters considered at a remote meeting; delivery of letters via the information portal. The aim of the article is to discuss the main solutions adopted by the legislator in the field of civil proceedings, aimed at preventing, counteracting and combating COVID-19, taking into account their functionality. The amendments to the provisions and their impact on the course of the pending civil proceedings were also discussed.
