The aim of paper is discussion on an indirect or direct coercion in the context of a consent of an incapacitated person to a medical procedure, particularly taking into consideration incapacitation in the result of a psy-chical disease, psychical retardation or another type of psychical disorders. This problem is worth considering because of many aspects contained in it. Since treatment takes place not only in hospitals; diagnostics is also carried out in social aid homes and institutions for psychically ill. The constitutional protection of a patient’s right to express his/her agreement or to refuse a consent to acquire definite health services obtains a particular meaning particularly in a situation where the subject authorised to express a con-sent (or refusal) is an incapacitated person/patient. The used method: a review of literature.

Celem artykułu jest omówienie przymusu pośredniego oraz bezpośredniego w kontekście zgody osoby ubezwłasnowolnionej na zabieg medyczny, ze szczególnym uwzględnieniem ubezwłasnowolnienia wskutek choroby psychicznej, niedorozwoju umysłowego albo innego rodzaju zaburzeń psychicznych. Zagadnienie to jest warte uwagi ze względu na jego wieloa-spektowość. Leczenie odbywa się bowiem nie tylko w szpitalach; diagnostyki prowadzone są również w domach pomocy społecznej i zakładach dla psychicznie chorych. Konstytucyjna ochrona prawa pacjenta do wyrażenia zgody lub jej odmowy na uzyskanie określonych świadczeń zdrowotnych zyskuje szczególne znaczenie w sytuacji, kiedy podmiotem upraw-nionym do wyrażenia zgody (lub jej odmowy) jest osoba/pacjent ubezwłasnowolniona/y.
