This study is addressed to the issue of possible fiscal penal liability for failure to pay the fuel fee. The aim of the article is to answer the question whether the fuel fee is criminalized under the fiscal penal code? In this regard, the basic principles of fiscal penal liability, the key concept of „tax” under the Fiscal Penal Code, as well as the legal nature of the fuel fee have been explained.

W niniejszym opracowaniu poruszono problem ewentualnej odpowiedzialności karnej skarbowej za nieuiszczenie opłaty paliwowej. Celem artykułu jest odpowiedź na pytanie, czy czyny zabronione związane z opłatą paliwową podlegają penalizacji na gruncie Kodeksu karnego skarbowego. Na te potrzeby wyjaśnione zostały podstawowe zasady odpowiedzialności karnej skarbowej, kluczowe na gruncie przywołanej ustawy pojęcie „podatku”, a także charakter prawny opłaty paliwowej
