The article broaches important for hundreds citizens of the commune issues regarding registration duty that contains act of 10 April 1974 about the public records and IDs (Official journal of 2006 No 139, position 993 with later changes). The legal status of the homeowner with a civil viewpoint is soundly established. Also constitutional principle of property protection gives a strong base to think that property law is well protected. However between sphere dominium and imperium establishing the status of a administrative party to procedure about announcing ones departure – the homeowner who left the place of residence without fulfilling registration duty – in practice of the organs of self-government and the officials in justiciary brings lots of doubts. The present article treats about this issue. Complexity of the topic requires wilder analysis legally cognitive including important issues such as access to public information or regarding real-state register. The article connects useful consideration for administrative practices with theoretical observation on the subject of administrative party to procedure.

The present article discusses the way cities with poviat rights in the Silesian Voivodeship deal with petitions submitted by their citizens. Since the Act on Petitions became law till the enforcement by the European Parliament and the Council of the European Union of the General Data Protection Regulation (GDPR) on data protection and privacy for all individuals with regards to the processing and export of personal data, 300 petitions were submitted to the councils of 19 cities. Data analysis leads to the conclusion that there is no uniform way of dealing with such cases. Each subject proposes different steps in dealing with petitions. Some subjects perform their tasks in an exemplary way, giving thus an example of conduct favourable to citizens; others constrain themselves to the statutory minimum, while yet another group does not comply with most of the statutory obligations.

Niniejszy artykuł traktuje o tym, w jaki sposób miasta na prawach powiatu województwa śląskiego postępują z petycjami obywateli. Od czasu wejścia w życie Ustawy o petycjach do chwili wejścia w życie rozporządzenia o ochronie danych osobowych i w sprawie swobodnego przepływu takich danych (tzw. RODO) do władz 19 miast złożono 300 petycji. Analiza danych pozwala dojść do wniosku, że nie ma jednolitej praktyki postępowania wobec tychże spraw. Każdy podmiot inaczej podchodzi do kwestii procedowania petycji - część wykonuje swoje zadania wzorowo, stanowiąc przykład proobywatelskiej postawy, część ogranicza się do ustawowego minimum, a cześć nie wypełnia większości ustawowych zobowiązań. Artykuł zawiera również wnioski z przeprowadzonych badań dotyczące ustanowienia ogólnowojewódzkiej praktyki postępowania z petycjami, a także zalecenia nowelizacji Ustawy o petycjach w pewnych jej obszarach.

The following study aims to define, describe and to demonstrate in selected real examples the tendency, which it has detected in the relation of advanced, democratic societies, towards the documents and resources of primarily oficial provenance, namely by the supreme representatives of public power. The tendency, according to the proposed thesis of this study, relies on the gradual implementation and enforcement of society’s claim to the ownership and access to writings, records, documents and historical resources of oficial provenance, in particular those by the supreme represenatives of the state. this contribution will also document the existence of this trend by outlining some legislative changes which have occurred since the middle of the 20th century up to the present day. Using this trend, this study aims to demonstrate, among others, the above and in what means some basic democratic mechanisms can implement themselves and further develop in relation to documents, textual and nontextual resources, namely on the part of historians, archivists and other persons participating in the administration of the documents of oficial provenance and future potential resources and of the whole of society. This contribution intends to outline the important and ever progressive transformation of public archives in recent decades as one of the crucial consequences thereof.
