The Bill is an attempt to provide state authorities with effective instruments to counteract corruption in public life, but the detailed legislative proposals contained therein may hinder the full implementation of this assumption. Among others the category of corruption offenses was drafted in a selective way, linking the tightening of the punishment policy with the conviction for only some of them. Failure to include some corruption offenses in the Bill will lead to an unjustified privileging of the policy of punishing corrupt practices in certain areas of public and economic life. The author also referred to some of the proposals to introduce employment bans, pointing out that they would be superfluous to the applicable regulations of the Criminal Code, as well as they would lead to consequences which would be difficult to accept from the perspective of seeking a penalty adequate to the committed prohibited act, the real severity of sanctions and the principle of equal punishment.

This article formulates the thesis that research is needed in the field of deliberative philosophy of administrative sciences. First of all, three general premises for the formulation of this thesis are indicated, namely: 1) the principle of sovereignty, understood in deliberative democracy as co-original with the rule of law; 2) a deliberative public philosophy which, from a contextual and particularistic point of view, considers the addressee of law as a full participant in the debate on law; and 3) the abstract principle of autonomy of will, according to which the addressee of law should also be able to understand themselves as an author of law. In the following steps, these general premises are analysed in the context of the triad of administrative sciences in order to provide more detail and context for the main thesis.

W niniejszym artykule zostaje sformułowana teza o konieczności prowadzenia badań z zakresu deliberatywnej filozofii nauk administracyjnych. Wprzódy zostają wskazane trzy przesłanki ogólne do sformułowania tej tezy, tj: 1) zasada demokracji ujmowana na gruncie demokracji deliberatywnej jako współźrodłowa z zasadą praworządności; 2) deliberatywna filozofia publiczna, która w nastawieniu kontekstualno partykularnym ujmuje adresata prawa jako pełnoprawnego uczestnika namysłu nad prawem oraz 3) abstrakcyjna zasada autonomii woli, zgodnie z którą adresat prawa powinien móc także rozumieć siebie jako twórcę prawa. W krokach następnych te zasady ogólne analizowane są w kontekście triady nauk administracyjnych gwoli uszczegółowienia i kontekstualizacji tezy głównej.

The article examines the application of the principle of the active role of the court in the administrative proceedings of the Republic of Kazakhstan and foreign countries. The attention is paid mainly to the identification of the main function and the system of application of this principle. The scientific novelty lies in the study of important subordinate guiding principles, the influence of which is decisive when applying the principle of the active role of the court in the administrative proceedings of the Republic of Kazakhstan. The authors conclude that the judge should apply the principle of the active role of the court in order to have a fair trial within a reasonable time.
