O dwóch odmianach wzorców osobowych w prawie karnym

The article is an attempt to determine whether the reasonable man standard used in criminal law constitutes a uniform category. The author concludes that this figure is applied on two basic levels: (i) to determine the perpetrator’s consciousness of actus reus, and (ii) to define the duty of care, including reasonable foreseeability. This observation makes it possible to distinguish two basic types of the aforementioned standard, which differ from each other not only in the subject of the reference but also in their internal structure.

Artykuł stanowi próbę określenia, czy stosowane w prawie karnym wzorce osobowe stanowią kategorię jednolitą. Autor dochodzi do wniosku, że figury te stosowane są na dwóch zasadniczych płaszczyznach: do ustalenia stanu faktycznego w zakresie stanu świadomości sprawcy czynu zabronionego oraz do określenia wymaganego od niego standardu postępowania w stosunku do dobra prawnego (co dotyczy również powinności przewidzenia określonych stanów rzeczy). Spostrzeżenie to pozwala na wyróżnienie dwóch zasadniczych odmian wzorców osobowych – wzorca rekonstrukcyjnego oraz wzorca optymalizacyjnego (normatywnego), które różnią się od siebie nie tylko przedmiotem odniesienia, ale i wewnętrzną konstrukcją.

Le but du présent article est d’explorer la relation entre les expressions bon père de famille et bonne mère de famille. L’expression bon père de famille renvoie au standard juridique de la personne raisonnable, récemment remplacée par les termes raisonnablement, raisonnable et personne raisonnable. Cet article envisage le contexte historique du standard de bon père de famille en droit français et présente l’analyse des occurrences des expressions bon père de famille et bonne mère de famille dans le corpus des textes juridiques.

Celem niniejszego artykułu jest zbadanie relacji między wyrażeniami bon père de famille i bonne mère de famille. Wyrażenie bon père de famille odnosi się do klauzuli generalnej prawa francuskiego, odpowiadającej polskiemu pojęciu należytej staranności. Wyrażenie to w ostatnich latach zostało zastąpione przez terminy raisonnablement, raisonnable oraz personne raisonable. Artykuł omawia tło historyczne klauzuli bon père de famille w prawie francuskim oraz przedstawia analizę wystąpień wyrażeń bon père de famille i bonne mère de famille w korpusie tekstów z dziedziny prawa.

The aim of this paper is to explore the relationship between the expressions bon père de famille and bonne mère de famille. The expression bon père de famille refers to the reasonable person standard of the French law and has been recently replaced by the terms raisonnablement, raisonnable and personne raisonable. This paper discusses the historical background of the bon père de famille standard in the French law and presents the analysis of occurrences of both expressions in the corpus of legal texts.
