Economic Crisis in Croatia

Croatia is becoming the 28th member of the European Union on July 1st, 2013. Croatia has gone a long way from a socialist republic to an independent country recognized as one of the economic tigers of the Western Balkans in the first decade of the 21st century. Croatia has been hit by the global crisis, which turned out to be a huge exter-nal shock for the region of the Western Balkans. Although it does not enter the economy through the direct channels, as local banks have not been engaged in toxic assets trade, but indirect channels, like the decrease of FDI, which deepens foreign trade deficits, slow credit growth or decrease of remittance which lead to economic disturbances during the last phase of the European integration process. Small economies, like Croatia, are exposed much more to the effects of any dis-turbances on the international scene. They are dependent on foreign trade and the inflow of FDI, while their demand and inflation rate are affected by the pace of changes in big economies. The article addresses the problem of economic development in the country which needs to deal with a problem of the economic crisis infection and the EU integration process. The article studies the economic situation in Croatia which is the consequence of a recovery plan undertaken by the Croatian government.

Przedmiotem artykułu koncepcyjnego jest ocena ewentualnego wpływu regulacji bankowych opracowywanych w wyniku kryzysu finansowego na ład korporacyjny, a ogólniej rzecz biorąc, na sposób zarządzania bankami. Weryfikacji poddano następującą hipotezę: w zasadzie żadna z wprowadzanych regulacji nie wpływa bezpośrednio na poprawę jakości ładu korporacyjnego w bankach. Nadziei na poprawę tego stanu rzeczy należy upatrywać w analizie i wnioskach z niej płynących dotyczących planów naprawczych przewidzianych przez Dyrektywę o naprawie i uporządkowanej likwidacji banków. Zastosowano metodę analizy wybranych aktów prawnych oraz opracowań Europejskiego Urzędu ds. Nadzoru Bankowego.

The subject of this conceptual article is to assess a possible impact of bank regulations being worked out in result of the financial crisis on corporate governance or, more generally, on the way banks are managed. The author verified the following hypothesis: in principle, none of the introduced regulations has a direct impact on improvement of the corporate governance quality in banks. The hope to improve this state of affairs should be seen in the analysis and conclusions stemming therefrom concerning the recovery plans envisaged by the Bank Recovery and Resolution Directive. There is applied the method of an analysis of the selected legal acts and studies of the European Banking Authority.

This paper is devoted to the issue of rights and obligations related to group recovery plans of mutal solidarity systems of co-operative banks, ie. institutional protection scheme or integrated associations. The legislator allows the creation of group plans to prevent the threat of bankruptcy of banks forming the solidarity system. The group recovery plan replaces, but does not exclude, individual recovery plans for co-operative banks beloging to the mutal solidarity systems. However, the group recovery plan is not the sum of individual recovery plans of the banks forming the mutual solidarity system.

Niniejsze opracowanie dotyczy uprawnień i obowiązków związanych z grupowymi planami naprawy banków należących do systemów solidarnościowych, tj. systemu ochrony instytucjonalnej lub zrzeszenia zintegrowanego. Ustawodawca dopuszcza tworzenie planów grupowych w celu zapobiegania stanowi zagrożenia upadłości banków tworzących system solidarnościowy. Grupowy plan naprawy zastępuje, lecz nie wyklucza, indywidualnych planów naprawy dla banków tworzących system solidarnościowy. Grupowy plan naprawy nie jest jednak sumą pojedynczych planów naprawy banków składających się na system solidarnościowy.
