Niniejszy artykuł przedstawia regulacyjne aspekty kary pieniężnej znanej ustawie Prawo telekomunikacyjne z 2004 r. Wskazano w nim takie elementy mające wpływ na pełnienie przez tę sankcję funkcji regulacyjnej, jak: status organu uprawnionego do jej nałożenia, ustawowe dyrektywy jej wymiaru, a także kategorie naruszeń, za które może być nałożona. Analiza tej instytucji prawa administracyjnego dokonana została z uwzględnieniem treści przepisów powszechnie obowiązującego prawa, jak również w świetle poglądów judykatury i doktryny oraz wybranych decyzji administracyjnych Prezesa Urzędu Komunikacji Elektronicznej.

The article presents regulatory aspects of fi nancial penalty established in Telecommunications Law of 2004. Discussed are the elements infl uencing the regulatory functions of the fi nancial penalty such as: the status of the regulatory body authorized to impose fi nancial penalties, statutory rules of the size of the penalty, and the categories of infringements punished by financial penalties. The analysis of this institution of administrative law bases on the provisions of the generally binding law, as well as on the views of the jurisprudence and doctrine and selected decisions of the President of UKE.
