The aim of the article is to assess the legal nature of the form of restricting access to activities in the field of organizing tourist events (as well as facilitating the purchase of linked travel services), which was introduced by the Act of 24 November 2017 on package travel and related travel services. The form of regulation of access to the above-mentioned activity does not, in essence, differ from that provided for in the provisions of the Entrepreneurs' Law Act in the case of regulated activity. However, it is not one of the three forms of regulation of economic activity known to the Law of Entrepreneurs, although it also includes the pursuit of economic activity. Therefore, it follows from the above that the catalog of forms of regulation of economic activity regulated by this Act is in some sense incomplete. The use of the regulated activity model by the legislator for the purposes of the system of restricting access to activities in the field of organizing tourist events and facilitating the purchase of related tourist services resulted in duplicating not only the advantages but also the disadvantages of the model.

Celem artykułu jest dokonanie oceny charakteru prawnego formy reglamentacji dostępu do działalności w zakresie organizowania imprez turystycznych (a także ułatwiania nabywania powiązanych usług turystycznych), jaką wprowadziła ustawa z 24.11.2017 r. o imprezach turystycznych i powiązanych usługach turystycznych. Forma tej reglamentacji w swej istocie nie różni się od tej, jaką przepisy ustawy z 6.03.2018 r. - Prawo przedsiębiorców (w skrócie u.P.p.) przewidują dla działalności regulowanej. Nie jest to jednak żadna z trzech form reglamentacji działalności gospodarczej uregulowanych w tej ustawie, chociaż obejmuje ona także wykonywanie działalności gospodarczej. Uregulowany w u.P.p. katalog form tej reglamentacji jest zatem w pewnym sensie niekompletny. Wykorzystanie przez ustawodawcę modelu działalności regulowanej na potrzeby systemu reglamentacji dostępu do działalności w zakresie organizowania imprez turystycznych i ułatwiania nabywania powiązanych usług turystycznych spowodowało, że powielone zostały nie tylko zalety, ale i wady wzorca.

This work contemplates the special legal character of supervision, which is as an expression of the rationing role of the state in relation to the regulated business activities. The supervision carried out by an administrative body which operates a register of regulated business activity is exercised over an entrepreneur who performs such regulated activity. The supervision is therefore of an on-going character. Any decision prohibiting the entrepreneur from performing regulated business activity should be a consequence of making an assessment that performance of such activity will breach the norms of the material law. The supervisory role is therefore particularly connected with verifying the legality of operating a business. The legal capacity to perform supervision vested with the registry bodies serves to fulfi l the purpose of supervision. That purpose is to ensure the entrepreneurs will observe legal requirements for performing a particular regulated business activity. However, that purpose is not to ration the business activity in a typical manner, in particular through creatively doling out permits for performing specific activities, and therefore its purpose is not to decide how many entities may operate on the market in a given sector.

The article discusses the administrative formal and legal conditions (administrative procedures) required when starting a business in order to offer services in the tourism industry. The formal and legal administrative conditions are not uniform in this respect, which can be attributed to both the lack of a common legal basis specifying the conditions for providing particular types of services in tourism, as well as to differences in the procedure of undertaking business activity. The formal and legal conditions have been specified by regulations in the Act of 2 July 2004 about the freedom of business activity and in the Act of 29 August 1997 about services in the tourism industry. Assuming the criterion of the legal basis as the foundation of the division, the article discusses four different legal situations, which can occur under the current legal condition that applies to undertaking business activity in providing services for tourism. In relation to the required administrative procedure three types of business activity have been specified: activity which does not require an administrative decision, activity which can be commenced after issuing an administrative decision and activity which can be undertaken on conditions other than those mentioned above.
