Finora l’immissione di nuovi alimenti sul mercato dell’UE è stata disciplinata sopratutto dal regolamento n. 258/97, con le soluzioni ivi previste valutate criticamente. A partire dal 1° gennaio 2018, le vigenti regolazioni giuridiche sono state sostituite dal regolamento n. 2015/2283. L’obiettivo delle considerazioni è di formulare la risposta alla domanda se e fino a che punto le soluzioni introdotte facilitino l’immissione di nuovi alimenti sul mercato dell’UE, garantendo al tempo stesso un elevato livello di tutela della salute e della vita dei consumatori e dei loro interessi economici. A parere dell’autore, il regolamento n. 2015/2283 introduce numerosi cambiamenti volti a facilitare l’immissione di nuovi alimenti sul mercato dell’UE che garantiscono al tempo stesso un elevato livello di tutela della salute e della vita dei consumatori e dei loro interessi economici. Tuttavia, solo la messa in pratica delle soluzioni proposte potrà determinare un’efficace apertura del mercato alimentare dell’UE verso innovazioni sicure.

Until recently, the introduction of novel foods into the EU market has been primarily governed by Regulation (EC) No 258/97. The solutions provided for in this legislative act have been criticised. Consequently, as of 1 January 2018, this act has been replaced by Regulation No. 2015/2283. The aim of the deliberations presented in this article is to answer the question whether and to what extent the new solutions actually facilitate the placing of novel foods on the EU market while ensuring at the same time a high level of protection of consumers’ health, life and economic interests. In the author’s opinion, Regulation No. 2015/2283 introduces many amendments aimed at facilitating the introduction of novel foods to the EU market, which also satisfy the above concerns. However, only the practice resulting from the application of the adopted solutions will determine the effectiveness of opening the EU food market to safe innovations.

Do niedawna wprowadzanie nowej żywności na rynek UE było regulowane głównie rozporządzeniem (WE) nr 258/97. Rozwiązania zawarte w tym akcie były jednak krytykowane. W konsekwencji od 1 stycznia 2018 r. zostało ono zastąpione rozporządzeniem nr 2015/2283. W artykule starano się odpowiedzieć na pytanie, czy i w jakim stopniu nowe rozwiązania ułatwiają wprowadzanie nowej żywności na rynek UE, zapewniając jednocześnie wysoki poziom ochrony zdrowia i życia konsumentów oraz interesy gospodarcze. Zdaniem autora rozporządzenie nr 2015/2283 wnosi wiele zmian mających ułatwić wprowadzanie na rynek UE nowej żywności. Jednak dopiero praktyka wynikająca ze stosowania przyjętych rozwiązań przesądzi o skuteczności otwarcia unijnego rynku żywności na bezpieczne innowacje.
