Military discipline is one of the key factors influencing the state of the armed forces. The scope of the indicated concept includes both the acceptance of a certain system of values, necessary for the functioning of the armed forces, and the observance of the rules of military institutions. Bearing in mind the indicated circumstances, it is necessary to ensure an acceptable level of military punitiveness, which is realised, inter alia, through the system of institutional criminal-military responsibility. This paper presents a legal analysis of individual acts recognised by the Polish legislator as offences against the principles of military discipline, and also presents the author’s evaluation of the adopted regulations both for the time of peace and a hypothetical armed conflict.

Dyscyplina wojskowa jest jednym z kluczowych czynników wpływających na stan sił zbrojnych. Przejawia się ona przede wszystkim w występowaniu ścisłego, hierarchicznego stosunku podporządkowania między żołnierzami niższego szczebla, a ich przełożonymi. W pojęciu dyscypliny wojskowej mieści się zarówno akceptacja określonego systemu wartości, niezbędnego dla funkcjonowania sił zbrojnych, jak i przestrzeganie zasad instytucji wojskowych. Konieczność zapewnienia akceptowalnego poziomu karności wojska wiąże się nieodłącznie z systemem instytucjonalnej odpowiedzialności karno-wojskowej. Niniejsza praca wskazuje i opisuje czyny uznane przez polskiego ustawodawcę za przestępstwa przeciwko zasadom dyscypliny wojskowej oraz przedstawia autorską ocenę przyjętych regulacji zarówno na czas pokoju jak i hipotetycznego konfliktu zbrojnego.
