The subject of the article is the relationship between the institution of the right to refuse to testify by a witness who is in a special, close relationship with the accused under Art. 186 of the Code of Criminal Procedure, and the crime of giving false testimony under Art. 233 of the Penal Code. The article attempts to demonstrate that there is an incompatibility between the above-mentioned provisions related to the statutory deadline for submitting a declaration to exercise the right to refuse to testify. There maybe a situation where – according to a possible interpretation – one of the features of the crime under Art. 233 Penal Code. The article identifies possible practical problems in this context and indicates possible attempts to solve them. A de lege ferenda postulate was also formulated to avoid interpretation doubts.

Tematyką artykułu jest relacja pomiędzy instytucją prawa do odmowy zeznań przez świadka pozostającego w szczególnym, bliskim stosunku z oskarżonym z art. 186 Kodeksu postępowania karnego a przestępstwem składania fałszywych zeznań z art. 233 Kodeksu karnego. W artykule podjęto próbę wykazania, że pomiędzy wskazanymi przepisami zachodzi niekompatybilność wiążąca się z ustawowym terminem złożenia oświadczenia na skorzystanie z prawa do odmowy zeznań. Może zaistnieć sytuacja, że – zgodnie z możliwą interpretacją – przestaje istnieć jedno ze znamion przestępstwa z art. 233 k.k. W artykule wskazano możliwe do zaistnienia na tym tle problemy praktyczne oraz możliwe próby ich rozwiązań. Sformułowano także postulat de lege ferenda pozwalający uniknąć wątpliwości interpretacyjnych.
