Jak wskazywał H.L.A. Hart, reguła uznania jest jedną z reguł wtórnych, która powinna stanowić remedium na niepewność reguł pierwotnych. W tekście zawarta została próba odpowiedzi na pytanie: w jakim stopniu reguła ta może gwarantować pewność prawa? Po omówieniu ważnych różnic między pojęciem reguły uznania a H. Kelsena koncepcją normy podstawowej (Grundnorm), zbadana zostaje rola reguły uznania w kontekście problemu zewnętrznej pewności prawa. Analizując jego treść, znaczenie i skutki zastosowania kryteriów walidacyjnych zawartych w regule uznania, odkryć można trzy typy niepewności powiązane z regułą uznania: substancjalną, interpretacyjną i aplikacyjną. Rozważania prowadzą zaś do wniosku, że reguła uznania, mająca na celu eliminowanie niepewności prawnej, jest sama w sobie jednym z jej źródeł. Trudno więc uznać ją za rzeczywiste i skuteczne rozwiązanie dla zewnętrznej niepewności prawa. Konstrukcja reguły uznania wskazuje, że stopień pewności uzyskany w wyniku jej zastosowania wydaje się większy niż w przypadku zwykłych reguł pierwotnych w ramach systemu, przy czym nigdy nie uzyskamy całkowitej zewnętrznej pewności prawa, jeżeli nie zastosujemy kolejnej konstrukcji teoretycznej.

According to H.L.A. Hart, the rule of recognition is one of secondary rules that is supposed to be a remedy for the uncertainty of primary rules. In this paper we will try to answer the question: To what extent may this rule guarantee legal certainty? After discussing important differences between the concept of the rule of recognition and Kelsenian concept of the basic norm (Grundnorm), we will examine the role of the rule of recognition in the context of the problem of the external certainty of law. When analyzing its content, meaning and effects of using the criteria of validity contained in the rule of recognition, we discovered three types of uncertainty related to the rule of recognition: the substantive, interpretive and applicative one. Our considerations have led us to the conclusion that the rule of recognition, having as its aim the function of removing the uncertainties of law, is itself one of the sources of these uncertainties. It is difficult to consider it as a genuine effective remedy to the external uncertainty of law. The construction of the rule of recognition means that the degree of certainty which we obtain as a result of its application appears to be greater than in the case of “ordinary” primary rules within the system, yet we will never obtain a total external certainty of law unless we apply another theoretical construction.

This article considers the formal unity of the system of law. In a formally unified legal system, there is in principle no doubt about which rules fall within the system and how to determine their content. The author tries to show how the formal unity relates to judge’s duty to law (Art. 95 of the Czech Constitution) and to the concept of the source of law. Special attention is paid to the rule of recognition and its ability to ensure formal unity of law in the situation of regulatory “outsourcing” to other social sub-systems.

Tato stať pojednává o formální jednotě systému práva. Ve formálně jednotném právním systému platí, že zásadně neexistují pochyby o tom, která pravidla do systému patří a jak určit jejich obsah. Autor se postupně pokusí ukázat, jak s formální jednotou souvisí vázanost soudce zákonem (čl. 95 Ústavy) a pojem pramene práva. Zvláštní pozornost bude věnována pravidlu uznání a jeho způsobilosti zajistit formální jednotu práva za situace „outsourcování“ regulace jiným společenským subsystémům.
