The article deals with the judicial review of invalid judgment. The author explain similarities and differences arising from the reform and revoke appeal model. Also he is considering whether reformatory variant of appeals is consistent with the constitutional principle of two-instance proceedings.

Artykuł dotyczy problematyki sądowej kontroli nieprawomocnych rozstrzygnięć sądowych. Autor wyjaśnia podobieństwa oraz różnice wynikające z reformatoryjnego i kasatoryjnego modelu postępowania odwoławczego. Ponadto rozważa, czy reformatoryjny wariant rozpoznawania apelacji pozostaje w zgodzie z konstytucyjną zasadą dwuinstancyjności postępowania sądowego.
