This article discusses the cassation institution in disciplinary cases of doctors. The basic differences between this cassation and the cassation provided for by the Code of Criminal Procedure are indicated. Due to the deontology of the disciplinary proceedings of doctors, there is no doubt that in the light of the Constitution it is permissible and even unavoidable to form such a model of conduct control on the professional liability of physicians, which provides for derogations from the standards in force in criminal procedure sensu stricto. The analysis of Supreme Court case law in disciplinary cases of doctors in terms of effective court protection takes into account the cassations of the years 2011-2016.

W artykule rozważana jest instytucja kasacji w sprawach dyscyplinarnych lekarzy. Wskazane zostały podstawowe różnice pomiędzy tą kasacją a kasacją przewidzianą przez przepisy kodeksu postępowania karnego. Ze względu na deontologię postępowania dyscyplinarnego lekarzy, nie ulega wątpliwości, że w świetle Konstytucji jest dopuszczalne i nawet nieuniknione, takie ukształtowanie modelu kontroli postępowania w przedmiocie odpowiedzialności zawodowej lekarzy, który przewiduje odstępstwa od standardów obowiązujących w postępowaniu karnym sensu stricto. Przeprowadzona w pracy analiza orzecznictwa Sądu Najwyższego w sprawach dyscyplinarnych lekarzy pod kątem efektywnej ochrony sądowej uwzględnia kasacje z lat 2011-2016.

Documents related to human rights indicate that respect for life and health is inherent in the medical profession. The doctor’s conduct is aimed at saving the patient’s life or health. At the same time, it is important that the patient’s dignity is not violated and his statutory rights are respected. In her work, the author would like to present her research on medical court rulings conducted in one of the largest medical courts in Poland, providing not only statistics but also numerous examples of authentic judgments. Unfortunately, the examples presented by the author show that modern medicine loses its deepest meaning, which is the good of the patient. Hence the postulate that the educational value resulting from the decisions of medical courts be used in the process of teaching doctors.

Dokumenty związane z prawami człowieka wskazują, iż szacunek dla życia i zdrowia jest nieodłączna cechą zawodu lekarza. Postępowanie lekarza nakierowane jest na ratowanie życia lub zdrowia pacjenta. Jednocześnie ważne jest, aby nie została naruszona godność pacjenta i były respektowane jego ustawowe prawa. W swojej pracy autorka pragnie zaprezentować swoje badania nad orzecznictwem sądów lekarskich prowadzone w jednym z największych sądów lekarskich w Polsce, podając nie tylko statystykę, ale i liczne przykłady autentycznych orzeczeń. Niestety przedstawione przez autorkę przykłady pokazują, iż współczesna medycyna gubi swój najgłębszy sens jakim jest dobro chorego. Stąd postulat, aby walor edukacyjny płynący z orzecznictwa sądów lekarskich wykorzystać w procesie nauczaniu lekarzy.
