The article discusses the issue of the influence of legal and moral sanctions on the effectiveness of law.First, the author defines the basic terms connected with the relevant problem, such as legal sanctions, moral sanctions, effectiveness of law and their kinds. Next, the discussion mainly focuses on the behavioural effectiveness, which is linked to the issue of observance of law.In reply to the question on what makes people act in accordance with law, particularly when it provides for patterns of behaviour that are burdensome to them, the Author states that legal sanctions are merely one of the factors conditioning the effectiveness of law. This stems, among others, from the fact that self-imposed legal motivation is rather quite a rare occurrence in people. Hence, the major significance, among other factors, of the approval of the content of norms, their internalisation, as well as certain habits and attitudes. Moral sanctions are of no lesser significance to the effectiveness of law as well.The mere sanctions established by the legislator (sanctions in the normative sense) will not enforce the effectiveness of legal norms, unless they are reflected and supported by the moral sanctions that convergently influence the specific subject of behaviour.

W artykule przedstawiona została problematyka wpływu sankcji prawnych i moralnych na skuteczność prawa.W pierwszej kolejności ustalono znaczenie podstawowych dla tych zagadnień terminów, takich jak sankcje prawne, sankcje moralne, skuteczność prawa i ich rodzaje.Następnie rozważania koncentrują się głównie na skuteczności behawioralnej, która wiąże się z problematyką przestrzegania prawa.W odpowiedzi na pytanie, co skłania ludzi do postępowania zgodnego z prawem, zwłaszcza gdy wyznacza ono zachowania dla nich uciążliwe, autor stwierdza, że sankcje prawne są tylko jednym z czynników warunkujących skuteczność prawa. Jest tak dlatego między innymi, że samodzielna motywacja prawna występuje u ludzi raczej dość rzadko. Stąd wśród innych czynników bardzo ważna jest aprobata treści norm, ich internalizacja, a także pewne nawyki i postawy. Nie mniej istotne znaczenie dla skuteczności prawa mają również sankcje moralne.Same ustanowione przez prawodawcę sankcje (sankcje w ujęciu normatywnym) nie wymuszą skuteczności norm prawnych, o ile nie znajdą oddźwięku i wsparcia w sankcjach moralnych zbieżnie oddziałujących na określony przedmiot zachowań.
