The expedited procedure is a type of special first-degree proceding which – apart from the cases specified in the Act on the Safety of Mass Events – is optional, also in cases of offenses prosecuted on the basis of private prosecution, if they are of hooligan nature. Insofar as it is permissible to reduce the formal requirements for charges to be presented in simplified proceedings, it is not possible to apply any simplification when it comes to evidence-based decision whether to file an indictment against a specific person. In cases involving offences prosecuted on the basis of private prosecution, it is not necessary to show public interest. Ap - prehension of the offender as a precondition of the procedure requires that all the conditions specified in Article 243 of the Code of Criminal Procedure are met. Apprehension “immediately after committing a crime” is not essentially equiva- lent to “in the pursuit immediately afterwards”. Time of suspect’s detention is counted to the nearest minute from the moment of actual deprivation of liberty or – in cases where suspect is apprehended – from the moment the apprehended person is taken over by the police.

Penal order proceedings are but one type of special procedure. They are characterised by a far-reaching reduction in formalism. The article discusses institutions which are characteristic for this type of proceedings, noting the admissibility of such solutions but also the dangers inherent in adjudication only on the basis of evidence collected by the public prosecutor. In addition, a detailed analysis of the positive and negative criteria for the use of penal order proceedings was presented.

The paper covers the issue of the accelerated penal procedure. It discusses conditions for the application of this mode under Polish law and presents them against the background of regulations in force in other countries, including Germany, France, Spain, Portugal and Belgium. The assumption of the study was to assess Polish legal solutions and to demonstrate the basic similarities and differences between laws of the aforesaid countries.

Artykuł poświęcony został problematyce postępowania przyspieszonego. Omówiono w nim przesłanki zastosowania tego trybu w prawie polskim i przedstawiono je na tle regulacji przyjętych w innych krajach, w tym m.in.: Niemczech, Francji, Hiszpanii, Portugalii i Belgii. Założeniami opracowania były: ocena polskich rozwiązań prawnych oraz wykazanie podstawowych różnic i podobieństw zachodzących pomiędzy poszczególnymi krajami.

Postępowanie nakazowe stanowi jeden z rodzajów postępowania szczególnego. Cechuje to postępowanie daleko posunięta redukcja formalizmu. W artykule omówiono instytucje charakterystyczne dla tego rodzaju procedowania, zauważając dopuszczalność takich rozwiązań, ale i niebezpieczeństwa kryjące się w orzekaniu wyłącznie na podstawie materiału dowodowego zebranego przez oskarżyciela publicznego. Ponadto, przedstawiono szczegółową analizę przesłanek pozytywnych i negatywnych postępowania nakazowego.

Order/writ procedure is a type of special procedure. It is characterized by a deep reduction of formalism. The article discusses the institutions characteristic of this type of procedure, pointing to the admissibility of this type of solutions and the risks related to examination of cases based solely on the evidence collected by the public prosecutor. A detailed analysis of positive and negative grounds for the order/writ procedure was provided.
