The article offers original research and theoretical characteristics of the concept of fundamental norms and principles of the national constitutions, forming the “scope of the review of the constitutions” from the standpoint of the international legal perception – as norms of Jus cogens, in the understanding of the content of this formula in the context of article 46 of the Vienna Convention on the law of treaties, 1969. A study of the ratio of domestic (Russian) law and the sources of international law in the context of conflict of laws decisions of the European Court of human rights in cases against the Russian state 20-ies of the XXIC.
