The article contains comments by Łukasz Pohl on proposed amendments to Article 60 of the Penal Code. The author disagrees with the statement that the premises of Article 60 paragraphs 1 and 2 of the Penal Code are different. In both cases, the premise for considering extraordinary mitigation of penalty is the court’s finding that the mildest punishment for the crime is disproportionately severe. This obsolesces the need for the proposed amendment.

Artykuł zawiera uwagi dotyczące zmian art. 60 Kodeksu karnego zaproponowanych przez Łukasza Pohla. Autor niniejszego tekstu nie zgadza się z twierdzeniem, że przesłanki art. 60 § 1 i 2 k.k. są zróżnicowane. W obu przypadkach wstępny warunek rozważania nadzwyczajnego złagodzenia kary to stwierdzenie sądu, że najniższa kara za przestępstwo jest niewspółmiernie surowa. Dezaktualizuje to potrzebę proponowanej nowelizacji.
