The commentary refers to the relationship between the bases of suspension of criminal trial and the running of the limitation period. The author believes that both opinions expressed by the Supreme Court are too categorical. With regard to the statement that the provision stating the limitation period only takes into account legal obstacles and not a factual obstacles, the author notes that this applies only to Article 104 § 1 of the Penal Code, however, it does not refer to other provisions of limitation. Regarding the view that the suspension of the criminal proceedings does not suspend the limitation period, the author notes, that this is true, but some circumstances may result in both suspension of proceedings and suspension of the limitation period. The Supreme Court’s view is therefore inaccurate.

Glosa dotyczy stosunku podstaw zawieszenia postępowania i spoczywania biegu terminu przedawnienia. Autor uważa za zbyt kategoryczne oba poglądy wyrażone przez Sąd Najwyższy. W odniesieniu do stwierdzenia, że przepis stanowiący o spoczywaniu biegu przedawnienia ma na względzie jedynie przeszkody natury prawnej, a nie przeszkody natury faktycznej, stwierdza, że odnosi się to tylko do art. 104 § 1 k.k., jednak nie odnosi się do innych przepisów przewidujących spoczywanie przedawnienia. W odniesieniu do poglądu, że zawieszenie postępowania nie wstrzymuje biegu przedawnienia, stwierdza, że jest to prawda, lecz niektóre okoliczności mogą skutkować zarówno zawieszeniem postępowania, jak i wstrzymaniem biegu przedawnienia. Pogląd Sądu Najwyższego jest zatem nieścisły.
