The commentary concerns the possibility of recognizing the terminal severe illness as a negative prerequisite for criminal proceedings. The author shares the view of the Supreme Court that such a disease is not a circumstance of this nature but for other reasons than indicated by the Supreme Court. He also states that the grounds for suspension of legal proceedings cannot be only real obstacles.

Glosa dotyczy kwestii możliwości uznania ciężkiej choroby terminalnej oskarżonego za okoliczność skutkującą koniecznością umorzenia postępowania karnego. Autor podziela pogląd Sądu Najwyższego, że choroba taka nie jest okolicznością tego rodzaju, ale z innych powodów niż wskazane przez Sąd Najwyższy. Opowiada się też przeciwko przyjęciu, że podstawą zawieszenia postępowania mogą być tylko przeszkody faktyczne.
