Pierwszej część pracy definiuje i charakteryzuje odpady jako czynnik wpływający negatywnie na estetykę naszych gmin. Ponadto wskazuje na ogólną kompetencję samorządu gminnego do zajmowanie się porządkiem i czystością. Zaprezentowane dane o poziomie recyklingu przedstawiają różnice w zachowaniu Polaków i innych Europejczyków w tym zakresie. Druga część pracy to analiza obowiązków gminy w zakresie odbioru i wywozu odpadów na gruncie rozwiązań prawnych obowiązujących dotychczas oraz zmian jakie zajdą w tym zakresie najpóźniej 1 lipca 2013 roku. Zakończenie podsumowuje zarówno wady jak i zalety nowego rozwiązania prawnego podkreślając cel regulacji. Uwagą natury ogólnej jest fakt, że państwo zobligowane do osiągnięcia określonych poziomów recyklingu przenosi realizację tegoż na samorządy. Jest to kolejny przykład specyficznej prywatyzacji ochrony środowiska.

First part of the paper defines and characterise waste as an element with negative influence on aesthetics of our communities. It also points on general competence of local community to deal with order and tidiness. Presented date on recycling present differences in behaviour of Poles and other Europeans regarding this matter. Second part of the paper analyses duties of the community in terms of waste collection and disposal according to previous law as well as the one valid no later than on July 1st of 2013. Conclusions sum up advantages and disadvantages of new legal regulations in regards to its aim. The general remark deal with the country, which is obliged to achieve certain level of recycling and transmit implementation of this duty on local communities. This is another example of specific privatisation of environmental protection.
