Celem niniejszej publikacji jest udowodnienie hipotezy, że unijne przepisy o koordynacji systemów zabezpieczenia społecznego mają skutki nie tylko koordynujące, lecz także materialnoprawne dla krajowych systemów zabezpieczenia społecznego. Przy projektowaniu regulacji prawnych na etapie praw legislacyjnych dotyczących krajowego ustawodawstwa polskiego (lub innego państwa członkowskiego UE) konieczne jest więc uwzględnienie skutków dla krajowego systemu zastosowania unijnych przepisów prawnych o koordynacji systemów zabezpieczenia społecznego – nie tylko w aspekcie koordynowania systemów, lecz także wpływu zastosowania tych unijnych przepisów na materialnoprawne elementy instytucji prawnych regulowanych prawem krajowym. W konsekwencji przy projektowaniu zmian legislacyjnych dotyczących krajowych instytucji zabezpieczenia społecznego przeprowadzana powinna być analiza skutków zastosowania prawa Unii Europejskiej na projektowane instytucje prawne (zmieniane regulacje).

The purpose of this publication is to prove the hypothesis that EU regulations on the coordination of social security systems have not only coordinating effects, but also material and legal effects on national social security systems. This means that when devising legislation at the stage of the legal legislation of Polish national legislation (or any other EU Member State), it is necessary to take into account not only the coordinative function of European regulations on the coordination of social security systems, but also the impact of applying these EU regulations on the material and legal elements of legal institutions as stipulated by national law. Consequently, when devising legislative changes for national social security institutions, an analysis of the effects of European Union law on the proposed legal institutions should always be conducted (revised regulations).
