Acceptance the freedom of contract between parties standing in equal position to each other, allows to point out some singular features of private law, especially including civil law as a comprehensive set of regulations upon civil contracts matter. Providing a wide range of legal tools that enables to freely participate in legal relations and create its provisions at ease as well, without any doubt determines distinctive attributes of civil contracts. Even though mentioned standards are within those given the ultimate priority, lawmaker stipulates certain circumstances for which it is acceptable to reduce parties' original will. One of such examples applies to tenancy and legal consequences associated with death of a tenant.

Przyjęcie za gwarant zasady swobody kontraktowania w ramach stosunków między podmiotami o równorzędnej względem siebie pozycji, pozwala na wskazanie pewnych specyficznych cech prawa prywatnego, w tym prawa cywilnego jako kompleksowego zbioru regulującego materię umów cywilnoprawnych. Zapewnienie spektrum narzędzi prawnych umożliwiających dobrowolne uczestniczenie oraz kreowanie stosunków należy bez wątpienia do walorów identyfikujących zawierane umowy cywilnoprawne. Pomimo jednak przyznania priorytetu zasadzie swobody umów oraz równości stron, ustawodawca przewiduje określone sytuacje, w których występują przejawy zachwiania stabilności w ramach istniejącego stosunku prawnego. Jednym z takich stosunków jest najem lokalu, który wprowadza dość szczególną konstrukcję dotyczącą śmierci najemcy i ewentualnego wstąpienia innych osób w jego stosunek najmu.
