Disputable filiation cases play a significant role in civil lawsuits. Hearing of evidence in the above-mentioned cases is tightly connected with proofs of biological nature, with DNA testing playing a special role, which, when properly done, permits an exclusion of fatherhood with 100% certainty or its determination with nearly 100% certainty.

Sprawy z zakresu spornej filiacji odgrywają szczególną rolę wśród procesów cywilnych. Procedura dowodowa w powyższych sprawach jest nieodzownie związana z dowodami natury biologicznej, wśród których szczególną rolę odgrywa dowód z badań DNA, który prawidłowo przeprowadzony pozwala ze stuprocentową pewnością na wykluczenie ojcostwa oraz z prawdopodobieństwem graniczącym z pewnością jego ustalenie.

Regularny wzrost ilości oferowanych testów genetycznych sprawia, iż dyskusja dotycząca etycznych aspektów ich przeprowadzania staje się coraz bardziej ożywiona i wielowątkowa. Prezentowany tekst stanowi przegląd wybranych zagadnień dotyczących charakterystyki, ochrony oraz jakości informacji pozyskiwanych dzięki przeprowadzaniu testów genetycznych. Omówione zostały najistotniejsze punkty sporów dotyczących możliwości uzasadnienia tzw. genetycznego ekscepcjonalizmu oraz sposobów doprecyzowania zakresu zasady poufności chroniącej prywatność informacyjną podmiotu. Końcowa partia tekstu została poświęcona prezentacji dyskusji nad znaczeniem, jakie przy podejmowaniu decyzji o wprowadzaniu kolejnych testów do użytku klinicznego powinny odgrywać możliwości praktycznego wykorzystania uzyskanych dzięki nim informacji.

The steady growth of the number of DNA tests offered results in the discussion on the ethical aspects of these tests becoming increasingly lively and multifaceted. This text provides an overview of selected issues concerning the characteristics, protection and quality of the information acquired as a result of carrying out DNA tests. I discuss the salient points in the debates on the possibility to justify the so-called genetic exceptionalism, and the ways of specifying the scope of the principle of confidentiality that protects the privacy of the information given by the subject. The final part of the article features the discussion on the importance of the possibility to use the information, acquired from these tests, in practice – for making decisions about the introduction of new kinds of tests for the clinical application.

One of the signs of the rapid development of medical genetics is a gradual increase in the number of genetic tests available. Different aspects of this phenomenon have been addressed and debated in the source literature, but so far relatively little has been said about the obligation to provide equal access – in the social context – to selected kinds of tests. In this article, I attempt to reconstruct those few suggestions, dealing with the principles of funding genetic tests from public resources, that can still be found in the source literature. Accordingly, I have analyzed the possibilities of identifying the criteria of selecting diagnostic and preventive tests (in the slightly modified sense attributed to these categories) to be eligible for refund, as well as of screening programmes.

Jednym z przejawów gwałtownego rozwoju genetyki klinicznej jest stopniowy wzrost liczby dostępnych testów genetycznych. W literaturze przedmiotu poruszane i dyskutowane są rozmaite aspekty tego zjawiska, niemniej, jak do tej pory, stosunkowo niewiele powiedziano na temat obowiązku zapewnienia równego – w kontekście społecznym – dostępu do wybranych testów. Prezentowany artykuł został poświęcony próbom zrekonstruowania tych nielicznych wskazówek dotyczących zasad finansowania testów genetycznych z funduszy publicznych, które w literaturze przedmiotu można jednak odnaleźć. Przeanalizowane zostały kolejno możliwości ustalenia kryteriów doboru zasługujących na refundację testów diagnostycznych i prewencyjnych (w nieco zmodyfikowanych znaczeniach, jakie nadano tym kategoriom) oraz programów przesiewowych.
