European research on the difficulties in exercising the right to free movement of EU citizens and their family members. The study discusses the development of the material scope of the freedom of movement of persons in the EU, which is analyzed on the basis of the EU laws and regulations. Special attention with particular emphasis on European research currently being conducted in this regard. A broad perspective on the rights issuing from the freedom of movement is presented. However, the varied character of these rights and lack of coherence between different legal acts and instruments complicates the application of the freedom of movement principle in the EU Member States. Moreover, the EU Member States put into force different obstacles and restrictions in the access to social security schemes and benefits. This problem is addressed by the Court of Justice of EU in numerous legal judgments, where the broad understanding of the freedom of movement is supported.

W opracowaniu dokonano analizy rozwoju zakresu przedmiotowego swobody przepływu osób na podstawie różnych regulacji prawa UE, ze szczególnym uwzględnieniem badań europejskich aktualnie prowadzonych w tym zakresie. Pokazano szerokie ujęcie uprawnień związanych ze swobodą przepływu osób. Jednak ich różnorodny charakter prawny, zwłaszcza brak spójności między rozmaitymi podstawami prawnymi, z których te uprawnienia wypływają, rodzi szereg problemów w ich stosowaniu w państwach członkowskich. Prawa krajowe bowiem stosują ograniczenia w dostępie do różnych uprawnień socjalnych, gwarantowanych z tytułu swobody przepływu osób w UE. Rangę problemu dostrzega TSUE i wydaje w tych sprawach liczne wyroki, potwierdzające słuszność szerokiego ujęcia uprawnień przypisanych swobodzie przemieszczania się osób w UE.
