The article discusses the jurisdiction of the Constitutional Tribunal and opinions of the doctrine on the subject of the introduction of single-member electoral districts in elections to the Senate, the possibility to vote by proxy and correspondence voting, a trial to extend the voting period over two days, and the introduction of limitations concerning the resources used during an election campaign. The adoption of these solutions emerged to meet the expectations of the doctrine, and fulfilled postulates of representatives of the electoral apparatus, in an essential way altering the electoral law, but simultaneously it aroused significant controversies. The Constitutional Tribunal was faced with a difficult task to evalu-ate them from the point of view of compatibility with the Constitution. Its adjudication was in advance doomed to criticism, because the Tribunal could only assume the point of view of a part of the doctrine’s representatives. The analysis carried out in this article enables the constitutional regulations concerning elections to be viewed in a new way.

The article presents the Electoral Code regulations which determine the relationship between the executive (mayor) and the municipal council (town council). Besides, regula-tions from other legal acts are indicated which have an impact on the phenomenon of cohabi-tation. In addition, the situation is explained where cohabitation appears in the municipality and is presented in the research on cohabitation in selected regions in Poland.

Przedmiotem niniejszych rozważań uczyniono pytanie, czy zakaz zamiany niektórych aktów normatywnych odczytywany z przepisu art. 228 ust. 6 Konstytucji RP obejmuje swym zakresem przedmiotowym również przepisy ustawy – Kodeks wyborczy, czy też przeciwnie – Kodeks ów może być poddany zmianom także w czasie trwania stanu nadzwyczajnego. Pytanie to, jest o tyle zasadne, że przepis art. 228 ust. 6 posługuje się szczególnym pojęciem „ordynacja wyborcza” niezastosowanym w tytule Kodeksu wyborczego. Rozważając przedmiotowe zagadnienie jedynie w warstwie językowej, nacechowanej formalizmem interpretacyjnym, można dojść do błędnego przekonania, iż zmiany Kodeksu wyborczego w czasie stanu nadzwyczajnego są dopuszczalne. Autor falsyfikując tę tezę, zdecydowanie opowiada się za twierdzeniem przeciwnym, zgodnie z którym w czasie stanu nadzwyczajnego nie może zostać zmieniony Kodeks wyborczy, ani żaden akt wykonawczy wydany na jego podstawie i w celu jego wykonania. Wszelkie zaś prace legislacyjne aktów tych dotyczące winny zostać zawieszone.

The article deals with the question, whether the limitation of particular laws’ amendments, sourced from the provision of the Article 228 section 6 of the Polish Constitution, covers the provisions of the Electoral Code or could that Code be changed during the state of emergency. The question is especially significant, because the above mention provision uses term of ‘electoral ordinance’ which is not used in the title of that Code. Formal and strict reconsideration of that’s question could mislead us to the conclusion, which says that the Codes’ changes are acceptable during the state of emergency. The Author, falsifying that thesis, advocates in favor of other conception, which explicitly express that neither the Codes’ nor its executives acts’ changes are acceptable during the state of emergency. The same limitation binds all legislative works connected with those legal acts, which shall be suspended.
