Celem artykułu jest analiza procedury senackiego zatwierdzenia kandydatów na sędziów Sądu Najwyższego Stanów Zjednoczonych, ze szczególnym uwzględnieniem możliwości wykorzystania obstrukcji parlamentarnej w formie znanej jako filibuster do blokowania prezydenckich nominacji. Temat taki jawi się jako interesujący w świetle współczesnej debaty nad reformami sądowniczymi w państwach europejskich. Przyjęta hipoteza badawcza zakłada, że zmiany wprowadzone do tej procedury w podczas ostatnich prób uzupełnienia składu sędziowskiego, po śmierci jednego z sędziów w 2016 roku, naruszyły dotychczasowe tradycje znaczenie ją osłabiając i upolityczniając.

The aim of the article is to examine the Senate’s procedure in the appointment of the US Supreme Court justices, with special emphasis on the use of filibuster as a mechanism to block the presidential nomination. The analysis seems significant in the light of the on-going debates concerning the judiciary reforms in the European countries. The adopted hypothesis presumes that changes implemented in the Senate procedure during the last attempts to fill the vacancy after death of one of the justices in 2016, have disturbed the established traditions and have significantly weakened and dangerously politicized the procedure.
