Kolizja prawa do firmy i prawa ochronnego na znak towarowy polega na możliwości wprowadzenia w błąd uczestników obrotu gospodarczego co do tożsamości pod-miotów używających identycznych lub podobnych oznaczeń. Ma to istotne znaczenie praktyczne ze względu na to, że konkretne wyrażenie użyte w firmie lub w znaku towarowym wiąże się z renomą wypracowaną w toku wykonywanej działalności gospodarczej. Rozstrzygnięcie, który podmiot jest uprawniony do danego wyrażenia, wynika z pierwszeństwa uzyskania prawa. Równie istotne –biorąc pod uwagę odmienność tytułów ochrony – jest ustalenie kwestii podobieństwa oznaczeń oraz ryzyka wprowadzenia w błąd.

The collision between the right of a company’s name and the rights of protection for a trademark is the possibility of misleading market players as to the identity of business entities using identical or similar emblems. This is of great importance due to the fact that the exact phrase used in a company or in the trademark is associated with the reputation developed in the course of business activity. The deciding of which business entity is entitled to the use of a given expression depends on the priority of obtaining the right of protection.
