RESEARCH OBJECTIVE: The purpose of this article is to present arguments against the possibility of adoption of a child by a homosexual person in the light of Polish family law.  THE RESEARCH PROBLEM AND METHODS: Since the Polish legislature does not explicitly accept or prohibit the adoption of a child by a homosexual person, the question of the possibility of adoption of a child by such a person is raised in the light of the principles of family law in force in Poland. There has been applied the method of critical and comparative analysis as well as the analysis of the reference literature, rulings of the Polish Supreme Court and Polish reference legislation. THE PROCESS OF ARGUMENTATION: After having initially defined the aim of the study, the author indicates the function and purpose of the adoption and its premises. Two basic premises of adoption are explained in detail - the premise of the best interests of the child and the appropriate personal qualifications of the adopter. The essential part of the argumentation is to find the answer to the question on whether adoption of a child by a homosexual person in the light of Polish family law is possible or not.   RESEARCH RESULTS: The result of this research is the statement of impossibility of adoption of a child by homosexuals in the light of Polish family law.  CONCLUSIONS, INNOVATIONS AND RECOMMENDATIONS: The analysis confirmed the dominant view in Polish doctrine according to which adoption of a child by homosexuals appears to be in contradiction of  the principle of the best interests of the child.

The study deals with the nature, interpretation and application of the notion of the child’s best interests. It is based on the requirement of special protection of children’s rights and at the same time the requirement of a certain degree of objectification of the indefinite legal concept concerning the child’s best interests. Certain problems of interpretation arise already when comparing the English original version and the Czech translation. The article focuses on these and other problems from the applicatory point of view, especially determining child’s best interest in court proceedings and related issues. Our study shows that in assessing and identifying the best interests of the child, it is above all important to recognize children’s right to self-determination and to enable them to participate in decisions that affect them. Last but not least, it criticizes the practice of using some means of evidence.

Studie se zabývá povahou, interpretací a aplikací pojmu nejlepší zájem dítěte. Vychází z požadavku zvláštní ochrany práv dítěte a současně požadavku určité míry objektivizace neurčitého právního pojmu nejlepší zájem dítěte. Určité problémy výkladu nastávají již při srovnání anglického originálního znění a českého překladu. Na tyto a další problémy se stať zaměřuje, z pohledu aplikačního pak zejména na zjišťování nejlepšího zájmu dítěte v soudním řízení a problémům s tím spojeným. Naše studie ukazuje, že při posuzování a zjišťování nejlepšího zájmu dítěte je nad míru důležité uznávat právo dětí na sebeurčení a umožnit jim participaci na rozhodnutích, která se jich týkají. V neposlední řadě se kriticky vyjadřuje k praxi využívání některých důkazních prostředků.
