In our times sources of the intellectual property universally are being regarded as the ones which are creating the considerable added value of the enterprise. In this situation effective managing of the intellectual property is one of the key challenges for the entrepreneurs. A protection of results of the intellectual artistic work, inventions, utility models, industrial designs, and trademarks is one of components of this management If the enterprise will not manage with patent solutions, it can lose – in the purely economic dimension – of extraordinary value creating not only capital, but constituting also an instrument of financing the next undertaking.

Współcześnie zasoby własności intelektualnej powszechnie uznaje się za te, które tworzą znaczącą wartość dodaną przedsiębiorstwa. W tej sytuacji jednym z głównych wyzwań stojących przed przedsiębiorcami jest efektywne zarządzanie własnością intelektualną. Jednym z komponentów tego zarządzania jest ochrona rezultatów twórczości intelektualnej, tj. utworów, wynalazków, wzorów użytkowych, wzorów przemysłowych, znaków towarowych itp. W niniejszej pracy rozważana jest problematyka znaczenia ochrony twórczości intelektualnej w działalności gospodarczej przedsiębiorstw. Omówiono instytucjonalne oraz alternatywne formy tej ochrony, wskazując na jej znaczenie w wymiarze praktycznym. Posiadanie prawa do ochrony własności intelektualnej oznacza bowiem, że dysponując wartością, mamy jako liderzy nadzwyczajne prawo do korzystania z rynku, czyli sprzedajemy z zyskiem pewnego rodzaju dobro rzadkie w postaci znaku czy patentu na wynalazek. Jeżeli nie zdążymy opatentować rozwiązania, pozbywamy się – w wymiarze czysto ekonomicznym – nadzwyczajnej wartości kreującej nie tylko kapitał, ale stanowiącej także instrument finansowania kolejnego przedsięwzięcia.
