Opracowanie zawiera analizę krytyczną współczesnego ujmowania problematyki gałęzi norm prawnych. Wyraźnie krytyczne stanowisko rozwiązań kontynentalnych w tym i polskich jest bezpośrednim skutkiem pojawiających się ostatnio w literaturze polskiej nauki prawa prób wyodrębniania kryteriów, a więc i ontologii prawa administracyjnego. Autor artykułu, na polu teoretycznym i ze wskazaniem odniesień praktycznych, kwestionuje zasadność takich zabiegów w świetle funkcjonalnej wartości prawa oraz poprawy społecznego dostępu do wymiaru sprawiedliwości.

The study contains a critical analysis of contemporary issues of branches of legal norms. In this article we can find clearly critical opinions concerning recent attempts in the Polish literature on the science of law to distinguish criteria of administrative law and thus its ontology. The article indicates, on the theoretical and practical basis, the need for future disputes about the validity of the abovementioned concepts and public procedures following them. The author of the article emphasizes that all these theoretical problems should be analyzed, in the first place, in the light of the functional value of the law such as public access to the administrative apparatus of justice.
