Autor artykułu podejmuje analizę treści konstytucyjnej zasady godności człowieka odnoszonej do statusu prawnego ofiary i sprawcy przestępstwa na gruncie prawa karnego. Wskazuje on, że o ile zakres podmiotowy tej zasady charakteryzuje zbieżność ochrony ofiary i sprawcy, o tyle jej zakres przedmiotowy cechuje się merytoryczną polaryzacją normatywnych konsekwencji wobec obu tych stron, wynikającą z aksjologicznych założeń odpowiedzialności karnej wskazanych w ustawie zasadniczej. Autor poświęca też uwagę zakazowi okrutnego, nieludzkiego i poniżającego traktowania interpretowanemu z perspektywy ochrony ofiar przestępstw.

The author analyzes the content of the constitutional principle of human dignity in relation to the victim and the perpetrator of a crime. The subjective scope of this principle is characterized by the convergence of the protection of the victim and the perpetrator, whereas its objective scope is characterized by a polarization of normative consequences, as a result of the constitutional assumptions of criminal liability. The author draws attention to the prohibition of cruel, inhuman and degrading treatment interpreted in light of the protection of victims of crime.
