Normative acts applicable in the Republic of Poland do not lack a multitude of formulations of terms such as: war, state of war or time of war. The lack of legally binding definitions and the inconsistency of the use of identical definitions lead to different, often contradictory interpretations of particular situations, which may have different legal consequences. Only a precise and detailed definition of these concepts, preferably by incorporating them into national or international law, would dispel many doubts and close the way to sometimes contradictory interpretations, which is particularly important for security and defence concepts and issues. Therefore, in this paper the author will present definitions and regulations resulting from Polish legal acts, relating to war, war time and the state of war.

The main objective of this paper is to investigate the differences between the state of war and the martial law in the Constitution of the Republic of Poland. The paper can be divided into two parts. The first one consists of the definition and the prerequisites for as well as the mode of introducing and ending the state of war. The author also distinguished the concept of the time of war. The second part of this article focuses on the martial law. It mentions the prerequisites for and modes of introducing the martial law as well as the mechanism of parliamentary control over its implementation. Additionally, the paper examines the territorial scope of the law, its possible duration and restrictions on the freedoms and rights of individuals. Finally, it discusses the special competence of the president to issue regulations as acts during martial law. In the conclusions, the author ascertains that the state of war and the martial law are not the same and shows the similarities and the differences between them indicating that there are more differences and therefore these institutions should not be treated as identical and the names should not be used interchangeably.

W artykule omówiono instytucje stanu wojny i stanu wojennego uregulowane w Konstytucji RP, ze wskazaniem, iż nie są to tożsame instytucje. W części pierwszej wskazano znaczenie pojęcia wojny, przesłanki, tryb wprowadzenia oraz zakończenie stanu wojny. Rozróżniono i wyodrębniono pojęcie czasu wojny. W drugiej części omówiono instytucję stanu wojennego. Wskazano przesłanki i tryb wprowadzenia stanu wojennego, mechanizm kontroli sejmowej nad jego wprowadzeniem, zasięg terytorialny obowiązywania, czas obowiązywania, ograniczenia wolności i praw jednostek w czasie stanu, oraz sposób zakończenia i szczególną kompetencję Prezydenta do wydawania rozporządzeń z mocą ustaw w czasie stanu wojennego. Końcowo wskazano, że porównanie tych stanów pokazuje, że są to dwa różne zagadnienia. Wyliczono podobieństwa i różnice pomiędzy instytucjami wskazując, że istnieje więcej różnic, dlatego nie powinny być traktowane jako tożsame, bądź wymiennie mylnie określane.

W aktach prawnych i najważniejszych dokumentach obowiązujących w Rzeczypospolitej Polskiej nie brakuje mnogości sformułowań pojęć takich jak: wojna, stan wojny czy czas wojny. Brak definicji prawnie wiążących oraz niekonsekwencja użycia definicji tożsamych prowadzi do różnych, często wykluczających się interpretacji danych sytuacji, co może nieść różne skutki prawne. Jedynie precyzyjne i ścisłe definiowanie powyższych pojęć, najlepiej poprzez wprowadzenie ich do prawa krajowego bądź międzynarodowego, spowodowałyby rozwianie wielu wątpliwości i zamknęłoby drogę do czasem wykluczających się interpretacji, co jest szczególnie ważne w zakresie pojęć i zagadnień związanych z bezpieczeństwem i obronnością. Dlatego też w pracy autorka przedstawi definicje i regulacje wynikające z polskich aktów prawnych, odnoszące się do wojny, czasu wojny i stanu wojny.

Legal acts and the most important documents in force in the Republic of Poland contain a multitude of wording of terms such as: war, state of war or time of war. The lack of legally binding definitions and the inconsistency of the use of similar (but not the same) definitions leads to different, often mutually exclusive interpretations of given situations, which may have different legal consequences. Only precise and strict defining of the above concepts by adopting their legal definitions would dispel many doubts and close the way to sometimes mutually exclusive interpretations. This is particularly important in terms of concepts and issues related to security and defense. Therefore, the author will present definitions and regulations resulting from Polish legal acts, referring to war, time of war and the state of war.
