Tożsamość prawa i jej kwalifikująca siła bierze się z istoty prawa. Jej zdefiniowanie tak, aby ostatecznie potwierdzało ją communis opinio doctorum jest niemożliwe, po prostu nieosiągalne. Czym by ona nie była, stanowi trudność chyba nieprzezwyciężalną, gdyż ma w sobie, i nie wiadomo jak łączy, rozmaite przecież idee, nierzadko o wzniosłym wyrazie, z prawem jako sferą niezwykle urozmaiconej faktyczności.
