Czym jest i na czym powinna polegać „zdolność” i „gotowość” bezrobotnego do podjęcia zatrudnienia albo innej pracy zarobkowej? Pojęcia te od ponad 25 lat są elementami budowy definicji bezrobotnego, jednak do tej pory nie zostały przez ustawodawcę zdefiniowane. W obowiązującej ustawie o promocji zatrudnienia i instytucjach rynku pracy również nie wyjaśniono ich znaczenia, co w znacznej mierze utrudnia rozumienie definicji bezrobotnego i jest problematyczne dla podmiotów dokonujących wykładni tej regulacji prawnej. Artykuł stanowi, przeprowadzoną na tle literatury przedmiotu oraz orzecznictwa sądów administracyjnych, analizę przesłanek zdolności i gotowości osoby bezrobotnej do podjęcia zatrudnienia albo innej pracy zarobkowej – może stać się przyczynkiem do rozwoju dyskusji na ten temat.

What is and what should “ability” and “readiness” of an unemployed person to undertake employment or other gainful work constitute? For over 25 years the two aforementioned notions have been building blocks in creating a definition of an unemployed person, however, the legislator has failed to provide it yet. In the current Act on the promotion of employment and labour market institutions their meanings have not also been cleared, what is a significant disincentive in defining an unemployed person as well as problematic for entities interpreting this legal regulation. The article presents an analysis, undertaken on the basis of academic literature and jurisdiction of administrative courts, concerning prerequisites of ability and readiness of an unemployed person to undertake employment or other gainful work – it may fuel the discussion on this topic.
