Umowę pośrednictwa w obrocie nieruchomościami należy uznać za odrębny rodzaj umowy nazwanej, której essentialia negotii tworzy zobowiązanie pośrednika do podejmowania czynności zmierzających do zawarcia umowy określonej w umowie pośrednictwa oraz zobowiązanie zamawiającego do zapłaty wynagrodzenia. Każda umowa zlecenia, która w swej treści wypełnia essentialia negotii umowy pośrednictwa, jest de facto umową pośrednictwa w obrocie nieruchomościami. Nie nazwa bowiem, ale treść decyduje o charakterze umowy.

Real estate contract should be regarded as a separate kind of nominate contract whose essentialia negotii creates obligation for an agent to undertake activities which will lead to concluding an agreement defined in real estate contract and obligation for a contractor to pay the remuneration. Every service contract which contains essentialia negotii of a real estate contract is in fact a real estate contract. For it is the contents not the term which constitutes the character of an agreement.
