Artykuł poświęcony jest wybranym problemom dotyczącym opłat likwidacyjnych w umowach ubezpieczenia na życie z ubezpieczeniowym funduszem kapitałowym. Opłaty te mają zniechęcać klientów do rozwiązywania umów przed upływem okresu ich obowiązywania, a tym samym zagwarantować ubezpieczycielom rentowność omawianych usług. Praktyka pokazuje jednak, iż powszechnym problemem jest zastrzeganie tych opłat w nadmiernej wysokości, nieadekwatnej do rzeczywiście ponoszonych przez ubezpieczycieli kosztów związanych z wykonywaniem umowy. Celem opracowania jest analiza charakteru prawnego opłat likwidacyjnych na tle specyfiki umowy ubezpieczenia na życie z ubezpieczeniowym funduszem kapitałowym oraz omówienie najistotniejszych argumentów ubezpieczycieli, uzasadniających pobieranie takich opłat. Rozważaniom towarzyszy przegląd orzecznictwa sądowego, które pozwala wskazać główne problemy związane z oceną legalności postanowień umownych odnoszących się do opłat likwidacyjnych.

The article concerns the selected problems connected with the termination fees in the contracts of unit-linked life insurance. The aim of these fees is to discourage the consumers to terminate the contract before its expiry date and thus to guarantee the profitability of aforementioned services. However, the practical experience shows the phenomenon of charging such fees in an excessive level, inadequate to the costs really incurred by the insurers. The main purpose of the article is the analysis of the legal nature of the termination fees in the context of the specificity of the contract of unit-linked life insurance, as well as the critical review of the main arguments of the insurers, justifying the charging of the discussed fees. The reflections are accompanied by the review of the judicature, pointing at the main problems connected with the assessment of the legality of the terms of contracts referring to the termination fees.
